These Terms of Service govern your access to and use of landmarkestimations.com and the construction estimating services provided by Land Mark Estimations Company

Land Mark Estimations provides construction cost estimating, quantity takeoff, and related bid-support services for general contractors, subcontractors, architects, owners, and other construction industry professionals. 2. Estimates Are Not Guarantees

All estimates, takeoffs, and pricing information provided by Land Mark Estimations are professional projections based on the plans, documents, and data supplied to us at the time of the estimate. They are not guarantees of final project cost, bid outcome, or material/labor pricing. Actual costs may vary due to market conditions, vendor pricing changes, project scope changes, site conditions, or other factors outside our control. Clients are responsible for independently verifying estimates before relying on them for binding bids or contracts.

3. Client Responsibilities

To provide accurate estimates, we rely on the completeness and accuracy of the plans, drawings, and information submitted by the client. We are not responsible for inaccuracies in estimates that result from incomplete, outdated, or incorrect information provided to us.

4. Use of the Site

You agree to use the Site only for lawful purposes. You may not:

• Use the Site in any way that could damage, disable, or impair its functionality
• Attempt to gain unauthorized access to any part of the Site or its systems
• Use automated systems (bots, scrapers) to access the Site without our permission
• Submit false or misleading information through our forms

Estimates, takeoffs, and deliverables provided to clients are licensed for the client’s use on the specific project for which they were prepared, unless otherwise agreed in writing.

6. Payment Terms

Where Services involve a fee, payment terms will be communicated at the time of engagement or in a separate agreement/invoice. Failure to pay per agreed terms may result in suspension of services or withheld deliverables.

7. Limitation of Liability

To the fullest extent permitted by law, Land Mark Estimations shall not be liable for any indirect, incidental, special, or consequential damages — including lost profits, lost bids, or project delays — arising from the use of our Site or Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from our Services shall not exceed the amount paid by the client for the specific estimate or service giving rise to the claim.

8. Indemnification

You agree to indemnify and hold harmless Land Mark Estimations, its owners, employees, and affiliates from any claims, damages, or expenses arising from your misuse of the Site, violation of these Terms, or reliance on an estimate without independent verification.

10. Termination

We reserve the right to suspend or terminate your access to the Site or our Services at our discretion, including for violation of these Terms.

11. Governing Law
